Say\u0131l\u0131 Karar\u0131<\/strong><\/h5>\n\n\n\n<p>Payl\u0131 m\u00fclkiyete tabi ta\u015f\u0131nmazlarda kira bedelinin tespiti, ortak m\u00fclkiyet sahipleri ile kirac\u0131lar aras\u0131nda en s\u0131k ya\u015fanan uyu\u015fmazl\u0131klardan biridir. \u00d6zellikle birden fazla payda\u015f\u0131n bulundu\u011fu gayrimenkullerde, her payda\u015f\u0131n yaln\u0131zca kendi pay\u0131 oran\u0131nda kira bedelinin belirlenmesini talep edebilmesi ve uzun s\u00fcredir ayn\u0131 ta\u015f\u0131nmazda kirac\u0131 olan ki\u015filere hakkaniyete uygun indirim uygulanmas\u0131, Yarg\u0131tay i\u00e7tihatlar\u0131yla netle\u015fmi\u015f temel ilkelerdendir.<\/p>\n\n\n\n<p>Yarg\u0131tay 3. Hukuk Dairesi\u2019nin 21 May\u0131s 2019 tarihli, 2017\/7770 Esas ve 2019\/4738 Karar say\u0131l\u0131 ilam\u0131, bu iki kritik hususa ili\u015fkin \u00f6nemli bir emsal karar niteli\u011findedir. Karar, payl\u0131 m\u00fclkiyette kira bedeli tespiti davas\u0131nda mahkemenin hatal\u0131 uygulamas\u0131n\u0131 d\u00fczelterek, hem payda\u015flar\u0131n dava a\u00e7ma yetkisinin s\u0131n\u0131rlar\u0131n\u0131 hem de eski kirac\u0131 lehine yap\u0131lmas\u0131 gereken indirim zorunlulu\u011funu a\u00e7\u0131k\u00e7a ortaya koymu\u015ftur.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Karar\u0131n De\u011findi\u011fi Temel Konular<\/h5>\n\n\n\n<p><strong>1. Payl\u0131 M\u00fclkiyette Payda\u015f\u0131n Kendi Pay\u0131 \u0130\u00e7in Kira Bedeli Tespiti Hakk\u0131<\/strong> Payl\u0131 m\u00fclkiyete tabi bir ta\u015f\u0131nmazda her payda\u015f, ta\u015f\u0131nmaz\u0131n tamam\u0131 i\u00e7in de\u011fil, yaln\u0131zca kendi pay\u0131na d\u00fc\u015fen oran dahilinde kira bedelinin tespitini isteyebilir. Kararda vurguland\u0131\u011f\u0131 \u00fczere, davac\u0131 payda\u015f dava dilek\u00e7esinde kendi pay\u0131 oran\u0131nda tespit talep etmi\u015f olmas\u0131na ra\u011fmen, mahkeme ta\u015f\u0131nmaz\u0131n tamam\u0131 y\u00f6n\u00fcnden karar vermi\u015ftir. Yarg\u0131tay, bu yakla\u015f\u0131m\u0131n hukuka ayk\u0131r\u0131 oldu\u011funu belirterek, payda\u015f\u0131n sadece kendi pay\u0131 i\u00e7in dava a\u00e7abilece\u011fini ve karar\u0131n da bu s\u0131n\u0131rlar i\u00e7inde verilmesi gerekti\u011fini h\u00fckme ba\u011flam\u0131\u015ft\u0131r. Bu ilke, payl\u0131 m\u00fclkiyetteki her payda\u015f\u0131n ba\u011f\u0131ms\u0131z haklar\u0131n\u0131 korurken, di\u011fer payda\u015flar\u0131n haklar\u0131n\u0131 ihlal etmemeyi ama\u00e7lamaktad\u0131r.<\/p>\n\n\n\n<p><strong>2. Eski Kirac\u0131ya Hakkaniyet \u0130ndirimi (Hak ve Nesafet \u0130lkesi) Zorunlulu\u011fu<\/strong> Kira bedeli tespitinde bilirki\u015fi raporunda ta\u015f\u0131nmaz\u0131n bo\u015f olarak kiraya verilmesi halinde olu\u015fabilecek rayi\u00e7 bedel esas al\u0131n\u0131r. Ancak daval\u0131n\u0131n 20 y\u0131l\u0131 a\u015fk\u0131n s\u00fcredir ayn\u0131 ta\u015f\u0131nmazda kirac\u0131 olmas\u0131 halinde, hak ve nesafet ilkesi gere\u011fi bu bedelden uygun bir indirim yap\u0131lmas\u0131 zorunludur. Kararda, mahkemenin bilirki\u015fi raporundaki br\u00fct 14.000 TL bedel \u00fczerinden herhangi bir indirim yapmadan karar verdi\u011fi belirtilmi\u015f ve bu durum bozma nedeni olarak g\u00f6sterilmi\u015ftir. Yarg\u0131tay, eski kirac\u0131n\u0131n uzun s\u00fcreli ili\u015fkisi, d\u00fczenli \u00f6deme ge\u00e7mi\u015fi ve ta\u015f\u0131nmazla kurdu\u011fu ba\u011f dikkate al\u0131narak hakkaniyete uygun indirim yap\u0131lmas\u0131 gerekti\u011fini vurgulam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p><strong>3. Genel De\u011ferlendirme ve Bozma Gerek\u00e7eleri<\/strong> Yarg\u0131tay, dosya kapsam\u0131ndaki deliller ve ke\u015fif raporunu inceledikten sonra, mahkeme karar\u0131n\u0131n iki temel y\u00f6nden hatal\u0131 oldu\u011funa h\u00fckmetmi\u015ftir:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Payda\u015f\u0131n kendi pay\u0131 d\u0131\u015f\u0131ndaki k\u0131s\u0131m i\u00e7in tespit yap\u0131lmas\u0131,<\/li>\n\n\n\n<li>Eski kirac\u0131 lehine indirim yap\u0131lmamas\u0131.<\/li>\n<\/ul>\n\n\n\n<p>Bu nedenle h\u00fck\u00fcm, daval\u0131 yarar\u0131na bozulmu\u015f ve yerel mahkemeye yeniden inceleme yap\u0131lmas\u0131 y\u00f6n\u00fcnde talimat verilmi\u015ftir.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Karar\u0131n Hukuki ve Pratik \u00d6nemi<\/h5>\n\n\n\n<p>Bu Yarg\u0131tay karar\u0131, payl\u0131 m\u00fclkiyette kira bedeli tespiti davalar\u0131nda uygulay\u0131c\u0131lar i\u00e7in yol g\u00f6sterici niteliktedir. Payda\u015flar a\u00e7\u0131s\u0131ndan, dava a\u00e7arken yaln\u0131zca kendi paylar\u0131 i\u00e7in talepte bulunman\u0131n \u00f6nemini; kirac\u0131lar a\u00e7\u0131s\u0131ndan ise uzun s\u00fcreli kirac\u0131l\u0131k ili\u015fkisinin bedel tespitinde lehlerine bir indirim hakk\u0131 do\u011furdu\u011funu netle\u015ftirmektedir. Hukuk Dairesi\u2019nin 2017\/7770 E. 2019\/4738 K. say\u0131l\u0131 ve 21.05.2019 tarihli tam karar metni yer almaktad\u0131r:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p id=\"viewer-gm2au5508\"><strong>Mahkemesi:<\/strong> Sulh Hukuk Mahkemesi<\/p>\n\n\n\n<p id=\"viewer-xru3f5978\">Taraflar aras\u0131ndaki kira bedelinin tespiti davas\u0131n\u0131n mahkemece yap\u0131lan yarg\u0131lamas\u0131 sonucunda, davan\u0131n k\u0131smen kabul\u00fcne y\u00f6nelik olarak verilen h\u00fckm\u00fcn, s\u00fcresi i\u00e7inde daval\u0131 vekili taraf\u0131ndan temyiz edilmesi \u00fczerine; temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra, dosya i\u00e7erisindeki ka\u011f\u0131tlar okunup gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"viewer-tfpoz5799\"><strong>KARAR<\/strong><\/h5>\n\n\n\n<p id=\"viewer-j0mpr5811\">Davac\u0131, daval\u0131n\u0131n, 1\/4 pay\u0131na malik oldu\u011fu ta\u015f\u0131nmazda 20 y\u0131l\u0131 a\u015fk\u0131n s\u00fcredir kirac\u0131 oldu\u011funu, ta\u015f\u0131nmaz\u0131n murisi taraf\u0131ndan 15\/05\/2000 tarihli kira s\u00f6zle\u015fmesi ile ayl\u0131k 150 TL bedelle daval\u0131ya kiraya verdi\u011fini, daval\u0131n\u0131n pay\u0131na kar\u015f\u0131l\u0131k 675 TL kira \u00f6dedi\u011fini, \u00f6denen kira bedelinin emsallerinin \u00e7ok alt\u0131nda oldu\u011funu belirterek ayl\u0131k kira bedelinin pay\u0131na d\u00fc\u015fen k\u0131sm\u0131n\u0131n yeni kira d\u00f6neminden ge\u00e7erli olmak \u00fczere 6.000 TL olarak tespitine karar verilmesini talep etmi\u015ftir.<\/p>\n\n\n\n<p id=\"viewer-fks4q6112\">Daval\u0131, davan\u0131n reddini istemi\u015ftir.<\/p>\n\n\n\n<p id=\"viewer-gxxz56136\">Mahkemece, davan\u0131n k\u0131smen kabul\u00fc ile 01\/05\/2015 tarihinden itibaren mecurun tamam\u0131 y\u00f6n\u00fcnden ayl\u0131k kira bedelinin br\u00fct 14.000,00 TL ( Net:11.200,00 TL ) olarak tespitine karar verilmi\u015f, h\u00fck\u00fcm daval\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n\n\n\n<p id=\"viewer-c0uvy6162\">1-) Dosyadaki yaz\u0131lara, karar\u0131n dayand\u0131\u011f\u0131 delillerle kanuni gerektirici sebeplere ve \u00f6zellikle delillerin takdirinde bir isabetsizlik bulunmamas\u0131na g\u00f6re daval\u0131n\u0131n sair temyiz itirazlar\u0131 yerinde de\u011fildir.<\/p>\n\n\n\n<p id=\"viewer-gdb2c6190\">2-) Dava konusu ta\u015f\u0131nmaz\u0131n 01\/05\/2000 ba\u015flang\u0131\u00e7 tarihli, bir y\u0131l s\u00fcreli s\u00f6zle\u015fme ile daval\u0131ya kiraland\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Kira bedelinin tespiti i\u00e7in ta\u015f\u0131nmaz mahallinde ke\u015fif yap\u0131lm\u0131\u015f, bilirki\u015fi kurulunun raporunda, dava konusu ta\u015f\u0131nmaz\u0131n bo\u015f olarak kiraya verilmesi halinde ayl\u0131k kira bedelinin br\u00fct 14.000 TL olacabilece\u011fi belirtilmi\u015ftir. Mahkemece, davac\u0131n\u0131n kiralayan olmad\u0131\u011f\u0131 dolay\u0131s\u0131yla da daval\u0131 ile aralar\u0131nda kirac\u0131l\u0131k ili\u015fkisi bulunmad\u0131\u011f\u0131; taraflar\u0131n karde\u015f olduklar\u0131, davac\u0131n\u0131n m\u00fclkiyet sahibi olmas\u0131ndan kaynakl\u0131 olarak i\u015f bu davay\u0131 a\u00e7t\u0131\u011f\u0131, uzun s\u00fcredir hissesine d\u00fc\u015fen kira bedelinin d\u00fc\u015f\u00fck d\u00fczeyde kald\u0131\u011f\u0131 gerek\u00e7esiyle bilirki\u015fi kurulunca belirlenen bedel \u00fczerinden takdiri indirim yap\u0131lmam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p id=\"viewer-qc3d96220\">Dava konusu ta\u015f\u0131nmaz\u0131n payda\u015f\u0131 olan davac\u0131 ayn\u0131 zamanda kiraya verenlerden &#8230; &#8216;un miras\u00e7\u0131s\u0131 olup halefiyet ilkesi gere\u011fi taraflar aras\u0131nda kirac\u0131l\u0131k ili\u015fkisi bulundu\u011fu gibi hak ve nesafete uygun kira belirlenirken ta\u015f\u0131nmaz\u0131n bo\u015f olarak yeniden kiraya verilmesi halinde getirebilece\u011fi kira bedelinden, daval\u0131n\u0131n eski kirac\u0131 oldu\u011fu g\u00f6zetilerek hakkaniyete uygun bir miktarda indirim yap\u0131lmas\u0131 gerekmektedir. Bu nedenle Mahkemece, daval\u0131n\u0131n eski kirac\u0131 oldu\u011fu g\u00f6zetilerek hakkaniyete uygun bir miktarda indirim yap\u0131larak kira bedelinin tespitine karar verilmesi gerekirken yaz\u0131l\u0131 gerek\u00e7e ile hak ve nesafet indirimi yap\u0131lmaks\u0131z\u0131n tespit karar\u0131 verilmesi do\u011fru de\u011fildir.<\/p>\n\n\n\n<p id=\"viewer-lmowj6252\">3-) Davac\u0131 dava konusu ta\u015f\u0131nmazda payda\u015f olup, payl\u0131 m\u00fclkiyette her payda\u015f kendi pay\u0131 oran\u0131nda kira bedelinin tespitini isteyebilir. Davac\u0131 da dava dilek\u00e7esinde pay\u0131 oran\u0131nda kira bedelinin tespitini talep etmi\u015ftir. Bu durumda Mahkemece, payl\u0131 m\u00fclkiyete tabi ta\u015f\u0131nmazlarda payda\u015f\u0131n sadece kendi pay\u0131 i\u00e7in kira tespiti davas\u0131 a\u00e7abilece\u011fi g\u00f6z\u00f6n\u00fcnde bulundurularak davac\u0131n\u0131n pay\u0131 oran\u0131nda kira bedelinin tespitine karar verilmesi gerekirken ta\u015f\u0131nmaz\u0131n tamam\u0131 i\u00e7in kira bedelinin tespitine karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015f, bozmay\u0131 gerektirmi\u015ftir.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"viewer-7rczi6047\"><strong>SONU\u00c7<\/strong><\/h5>\n\n\n\n<p id=\"viewer-4znnp6083\">Yukar\u0131da birinci bentte a\u00e7\u0131klanan nedenlerle daval\u0131n\u0131n sair temyiz itirazlar\u0131n\u0131n reddine, ikinci ve \u00fc\u00e7\u00fcnc\u00fc bentlerde a\u00e7\u0131klanan nedenlerle temyiz itirazlar\u0131 yerinde oldu\u011fundan kabul\u00fc ile h\u00fckm\u00fcn HUMK. nun 428. maddesi gere\u011fince daval\u0131 yarar\u0131na BOZULMASINA ve pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n istek halinde temyiz edene iadesine, 6100 say\u0131l\u0131 HMK&#8217;nun ge\u00e7ici madde 3 atf\u0131yla 1086 say\u0131l\u0131 HUMK.nun 440.maddesi gere\u011fince karar d\u00fczeltme yolu kapal\u0131 olmak \u00fczere, 21\/05\/2019 tarihinde oybirli\u011fiyle karar verildi.<\/p>\n<\/blockquote>","protected":false},"excerpt":{"rendered":"<p>Payl\u0131 M\u00fclkiyette Kira Bedeli Tespiti Davalar\u0131nda Payda\u015f\u0131n Kendi Pay\u0131 \u0130\u00e7in Talep Hakk\u0131 ve Eski Kirac\u0131ya Hakkaniyet \u0130ndirimi: Yarg\u0131tay 3.
